IDENEL AUSTRALIA
TERMS OF SERVICE
Last updated: September 2026
1. About These Terms
This website and online store are operated by Luxura Australia Pty Ltd (ABN 78 645 265 130), trading as IDENEL Australia (“IDENEL Australia”, “we”, “us” or “our”).
These Terms of Service (“Terms”) govern access to and use of this website, online store and related services (“Services”), including purchases made through the website.
Our online store is hosted by Shopify, which provides the ecommerce platform through which we offer Products and Services. Unless expressly stated otherwise, purchases made through this website are transactions with Luxura Australia Pty Ltd.
By accessing or using the Services, creating an account, placing an order or expressly accepting these Terms at checkout, you agree to be bound by these Terms.
Certain Products are designated as professional-use Products or Professional Trial Packs and are subject to additional requirements contained in these Terms.
Purchasing a Professional Trial Pack does not appoint the purchaser as an authorised IDENEL Clinic Partner, stockist, distributor, agent or representative.
Where a purchaser subsequently becomes an authorised IDENEL Clinic Partner and enters into a separate Clinic Partner Agreement, that agreement applies in addition to these Terms.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, remedy, duty or liability under the Australian Consumer Law or other applicable law that cannot lawfully be excluded, restricted or modified.
2. Eligibility, Accounts and Information
You must be legally capable of entering into a binding agreement to purchase Products through this website.
You must provide accurate, current and complete information when creating an account or placing an order.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity undertaken through your account.
Professional accounts, wholesale access, training access and restricted professional materials must not be transferred, shared or made available to unauthorised persons.
IDENEL Australia may reasonably request information necessary to verify eligibility to purchase professional-use Products or access restricted professional education.
3. Products
We take reasonable steps to ensure that Product descriptions, images, pricing and information displayed on the website are accurate.
Product packaging, appearance, presentation or colour may vary from images displayed online, including where packaging or branding has been updated.
Product availability may change and Products may be discontinued, withdrawn or temporarily unavailable.
IDENEL Australia may reasonably limit quantities or restrict supply where necessary because of Product availability, Product safety, professional-use requirements, suspected unauthorised resale or diversion, regulatory requirements or another legitimate operational or compliance reason.
Nothing in this Section affects any right or remedy that cannot lawfully be excluded.
4. Professional Trial Packs
4.1 Professional Use Only
Certain Products or kits offered through this website are identified as Professional Trial Packs and may contain Products intended solely for professional treatment use.
Professional treatment Products contained in a Professional Trial Pack must only be used by an appropriately trained skin therapist or other suitably qualified practitioner who is competent, appropriately insured and legally permitted to perform the relevant treatment.
Purchase of a Professional Trial Pack does not constitute certification, accreditation, endorsement or confirmation by IDENEL Australia that the purchaser or any practitioner is qualified, competent, insured or legally permitted to perform the treatment.
The purchaser is responsible for determining and ensuring that these requirements are satisfied before any treatment is performed.
4.2 Mandatory Trial Training
Before performing or assisting with an IDENEL professional treatment using a Professional Trial Pack, the treating practitioner must:
(a) personally watch and complete the mandatory training video or other trial training supplied or nominated by IDENEL Australia;
(b) read and understand the current treatment Protocol supplied or made available by IDENEL Australia;
(c) review the current contraindications, precautions, warnings and after-care requirements applicable to the treatment;
(d) ensure they understand the correct Product selection, preparation, application, quantity, timing, technique and treatment procedure; and
(e) seek clarification from IDENEL Australia before performing the treatment if they do not understand any aspect of the training or Protocol.
The professional treatment must not be performed until these requirements have been completed.
4.3 Training Does Not Establish Competency
Watching or completing the mandatory trial training, receiving educational materials or being permitted to purchase a Professional Trial Pack does not constitute a representation, guarantee or warranty by IDENEL Australia that the practitioner is clinically competent, appropriately qualified, appropriately insured or legally permitted to perform the treatment.
The purchaser, treating business and treating practitioner remain responsible for determining and ensuring practitioner competency, qualifications, insurance and legal authority to perform the treatment.
4.4 Treatment Responsibility
The treating business and treating practitioner are responsible for the professional treatment they provide.
This includes responsibility for:
(a) Client consultation and assessment;
(b) determining Client suitability;
(c) obtaining and assessing relevant Client history;
(d) identifying and appropriately responding to contraindications, precautions and warnings;
(e) obtaining valid informed consent;
(f) ensuring the practitioner is appropriately trained, competent, insured and legally permitted to perform the treatment;
(g) reading, understanding and following the current IDENEL Protocol;
(h) correct Product selection, preparation, application, amount, timing and technique;
(i) Client monitoring during and following treatment;
(j) providing appropriate after-care and follow-up;
(k) responding appropriately to reactions, complications or concerns; and
(l) arranging appropriate referral or escalation where required.
4.5 Incorrect or Non-Compliant Treatment Delivery
To the maximum extent permitted by law, Luxura Australia Pty Ltd is not responsible for loss, injury, adverse reaction, complaint, claim, liability, cost or damage to the extent caused or contributed to by:
(a) incorrect, negligent, unauthorised or non-compliant treatment delivery;
(b) failure to complete the mandatory trial training before performing the treatment;
(c) failure to read, understand or follow the current IDENEL Protocol;
(d) inadequate Client consultation, assessment or screening;
(e) failure to identify or appropriately respond to a contraindication, precaution or warning;
(f) failure to obtain valid informed consent;
(g) treatment performed by a person who is not appropriately trained, competent, insured or legally permitted to perform it;
(h) incorrect Product selection, preparation, amount, application, timing or technique;
(i) use of a Product in a manner inconsistent with its directions, warnings or the current Protocol;
(j) combining a Product with another product, device, treatment or modality where that combination is prohibited or has not been identified as approved in current IDENEL materials;
(k) inadequate monitoring, after-care, follow-up or escalation; or
(l) another negligent, unlawful or unauthorised act or omission of the purchaser, treating business, treating practitioner or their personnel.
Nothing in this Section excludes or restricts liability to the extent directly caused by a Product defect for which Luxura Australia Pty Ltd is legally responsible, an act or omission of Luxura Australia Pty Ltd for which it is legally responsible, or another liability that cannot lawfully be excluded, restricted or transferred.
4.6 Trial Purchase Does Not Create Clinic Partner Status
Purchase or use of a Professional Trial Pack does not:
(a) appoint the purchaser as an authorised IDENEL Clinic Partner or stockist;
(b) authorise the purchaser to represent that it is an authorised IDENEL Clinic Partner;
(c) grant any territory, postcode, suburb, city, region, Client, channel or other exclusivity;
(d) grant unrestricted rights to resell IDENEL Products;
(e) authorise independent online sale of IDENEL Products;
(f) appoint the purchaser as a distributor, representative, agent or partner of IDENEL Australia;
(g) grant rights to use IDENEL intellectual property except as expressly authorised or reasonably necessary to evaluate and use the trial Products in accordance with these Terms; or
(h) guarantee that the purchaser will subsequently be accepted as an authorised IDENEL Clinic Partner.
5. Professional Trial Product Restrictions
Professional-use Products must not be used contrary to current Product instructions, Protocols, contraindications, precautions, warnings or professional-use requirements.
The purchaser must not represent an unapproved Product, device, treatment or modality combination as being approved, recommended or endorsed by IDENEL Australia.
Professional Trial Pack Products must not be supplied, wholesaled or transferred to another business or person for unauthorised resale.
Professional trial access is provided for legitimate professional evaluation and treatment use in accordance with these Terms.
6. Orders
Placing an order constitutes an offer to purchase.
An order is accepted when IDENEL Australia confirms acceptance or fulfils the order.
We may reasonably refuse, limit, hold or cancel an order because of Product unavailability, payment failure, suspected fraud, professional eligibility requirements, suspected unauthorised resale or diversion, Product safety or regulatory requirements, material breach of these Terms or another legitimate reason relating to the transaction.
Where we cancel an order after payment has been received and the affected Product is not supplied, we will refund the amount paid for that Product unless another lawful arrangement is agreed.
7. Pricing, GST and Payment
All prices are displayed in Australian dollars unless otherwise stated.
Prices displayed to Australian consumers include GST where applicable unless clearly stated otherwise.
Shipping and other applicable charges will be disclosed at or before checkout where reasonably practicable.
Prices, Product availability and promotions may change prospectively.
A price change does not retrospectively alter the price of an order already accepted except where permitted by law or agreed with the purchaser.
You must be authorised to use any payment method submitted.
8. Shipping and Delivery
We will take reasonable steps to dispatch accepted orders within communicated timeframes.
Delivery timeframes are estimates and may be affected by carriers, weather, remote locations, public holidays or circumstances outside our reasonable control.
Nothing in these Terms excludes any statutory right or remedy arising from a failure to supply Products within a timeframe required by applicable law.
Additional shipping, title and risk provisions may apply to authorised wholesale or Clinic Partner purchases under a separate written agreement.
9. Returns, Refunds and Australian Consumer Law
Returns, refunds and exchanges are subject to our Refund Policy and applicable law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms or our Refund Policy excludes, restricts or modifies a right to repair, replacement, refund, compensation or another remedy where that right exists under applicable law.
Change-of-mind returns may be subject to our Refund Policy and are separate from statutory rights concerning faulty, unsafe, incorrectly described or otherwise non-compliant Products.
10. Product Safety, Adverse Reactions and Complaints
Products must be stored, handled and used in accordance with current instructions, Protocols, contraindications, precautions, warnings and safety information.
If a purchaser or practitioner reasonably suspects that a Product is defective, contaminated, damaged, incorrectly labelled or associated with a serious or unusual adverse reaction, use of the affected Product should cease where appropriate and IDENEL Australia should be contacted promptly.
The purchaser should retain the affected Product, packaging and relevant batch or lot information where reasonably practicable while the matter is assessed.
The treating practitioner remains responsible for immediate Client assessment and appropriate care, referral or escalation within their lawful scope of practice.
Nothing in this Section replaces any mandatory reporting, professional, regulatory, insurer or other legal obligation applying directly to the purchaser, practitioner or IDENEL Australia.
11. Resale and Online Sales
Purchase of a Professional Trial Pack does not automatically authorise the purchaser to become an IDENEL reseller or stockist.
Unless expressly authorised in writing by IDENEL Australia, a professional trial purchaser must not independently sell IDENEL Products through an ecommerce website, social-media shop, online marketplace, application or other online checkout channel.
Authorised Clinic Partners may sell Products only through channels permitted by their Clinic Partner Agreement and may participate in an IDENEL Australia affiliate or referral program where separately authorised.
Products must not be diverted, wholesaled or supplied to unauthorised resellers for further resale.
12. Intellectual Property and Training Materials
All intellectual property rights relating to IDENEL, Products, Protocols, training, ALTUM® Academy, videos, treatment materials, trademarks, logos, Product information, photographs, graphics, written materials and website content remain owned by their respective owners or licensors.
Purchase of a Product does not transfer ownership of IDENEL intellectual property.
Training videos, Protocols and restricted professional materials are supplied solely for authorised professional education and Product use.
They must not be copied, reproduced, published, sold, shared publicly, provided to unauthorised persons or commercially exploited without written authorisation, except to the extent permitted by law.
13. Marketing and Representations
A trial purchaser must not represent itself as an authorised IDENEL Clinic Partner, IDENEL Australia, an IDENEL distributor or an agent or representative of Luxura Australia Pty Ltd.
Professional purchasers must not make false, misleading, exaggerated, unsupported or unauthorised claims regarding IDENEL Products, technology, mechanisms, treatments or results.
Professional purchasers must comply with applicable advertising, consumer and professional requirements when promoting treatments or Products.
No numerical spicule claim, including a reference to “1.5 million” spicules, may be represented as an IDENEL Australia-approved claim unless contained in current IDENEL Australia-approved materials or expressly approved in writing for the relevant use.
14. Website Use
The Services must not be used unlawfully, fraudulently or in a way that:
(a) interferes with website security or operation;
(b) introduces malicious software;
(c) impersonates another person;
(d) obtains unauthorised access to restricted professional materials or accounts;
(e) infringes intellectual property, privacy or other legal rights;
(f) unlawfully collects or uses information concerning another person; or
(g) otherwise materially breaches these Terms.
We may reasonably suspend or restrict access where necessary to address fraud, security, unlawful conduct or a material breach.
15. Shopify and Third-Party Services
Our online store is hosted by Shopify.
We may also use third-party payment, delivery, technology and service providers.
Unless expressly stated otherwise, purchases of IDENEL Products through this website are transactions with Luxura Australia Pty Ltd, not Shopify.
Third-party services may be subject to their own terms and privacy practices.
Nothing in this Section excludes any right or liability that cannot lawfully be excluded.
16. Privacy and Client Information
Personal information collected through the website is handled in accordance with our Privacy Policy and applicable privacy law.
Where information concerning a Client's health, treatment or adverse reaction is provided to IDENEL Australia for Product safety, complaint handling, investigation, traceability, recall, regulatory or another lawful purpose, it will be handled in accordance with applicable privacy requirements.
Professional purchasers and treating businesses remain responsible for ensuring that Client information they collect, hold, use or disclose is handled lawfully and securely.
Where Client information is disclosed to IDENEL Australia, the purchaser must ensure that the disclosure is lawful, including obtaining consent where consent is required.
Nothing in these Terms authorises a purchaser to disclose Client information unlawfully.
17. Reviews, Photographs and User Content
Where you voluntarily provide a review, photograph, video, testimonial or other content for publication or promotional use, you must have the right to provide that content.
Where identifiable Client material is supplied for marketing or promotional use, the person supplying it must ensure that all permissions and consents required by applicable law have been obtained.
Treatment consent does not automatically constitute consent for marketing use where separate consent is required.
IDENEL Australia may decline to publish or may remove content that is unlawful, misleading, infringing, offensive or otherwise inappropriate.
18. Website Errors
We may correct genuine typographical, technical, pricing, Product availability or other website errors.
Where an error materially affects an order already submitted, we may contact the purchaser to correct the order or, where lawful, cancel the affected item and refund the amount paid for that item.
Nothing in this Section limits statutory rights.
19. General Information and Treatment Outcomes
Website information, Product education, Protocols and training materials are provided for Product and professional education purposes and do not constitute individual medical advice, diagnosis or treatment advice.
Treatment outcomes may vary between Clients.
IDENEL Australia does not guarantee a particular treatment outcome unless an express guarantee is specifically made.
The treating business and treating practitioner remain responsible for individual Client assessment, suitability and treatment decisions.
20. Professional Purchaser Responsibility and Indemnity
This Section applies where the purchaser purchases a Professional Trial Pack or another professional-use Product in connection with a business, profession or professional service.
To the maximum extent permitted by law, the professional purchaser is responsible for loss or liability to the extent caused or contributed to by its own acts or omissions or those of its practitioners, employees, contractors or other personnel.
To the maximum extent permitted by law, the professional purchaser indemnifies Luxura Australia Pty Ltd and its officers and employees against third-party claims, liabilities, losses and reasonable legal costs to the extent caused by:
(a) negligent, incorrect, unlawful or unauthorised treatment delivered by the purchaser or its personnel;
(b) failure to complete mandatory trial training before treatment;
(c) material failure to read, understand or follow the current IDENEL Protocol;
(d) treatment by a practitioner who is not appropriately trained, competent, insured or legally permitted to perform the treatment;
(e) inadequate Client screening, consent, monitoring, after-care or escalation;
(f) unauthorised Product resale or diversion;
(g) unlawful, misleading or unauthorised advertising created or published by the purchaser;
(h) unlawful or unauthorised misuse of IDENEL intellectual property or restricted training materials; or
(i) the purchaser's material breach of these Terms.
This indemnity does not apply to the extent that the relevant claim, liability, loss or cost is caused or contributed to by negligence, unlawful conduct or breach by Luxura Australia Pty Ltd, a Product defect for which Luxura Australia Pty Ltd is legally responsible, or another liability that cannot lawfully be excluded, restricted or transferred.
21. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies:
(a) the Australian Consumer Law;
(b) an applicable consumer guarantee;
(c) a statutory right or remedy;
(d) liability for a Product defect where Luxura Australia Pty Ltd is legally responsible;
(e) liability to the extent caused by negligence, unlawful conduct or breach by Luxura Australia Pty Ltd; or
(f) any other liability,
where its exclusion, restriction or modification would be unlawful.
Subject to the above and to the maximum extent permitted by law, Luxura Australia Pty Ltd is not responsible for loss, injury, damage or liability to the extent caused or contributed to by:
(a) misuse of a Product;
(b) failure to follow Product directions, warnings or current Protocols;
(c) failure to complete required professional trial training before treatment;
(d) incorrect, negligent, unlawful, unauthorised or non-compliant professional treatment;
(e) treatment by a person who is not appropriately trained, competent, insured or legally permitted to perform it;
(f) an unauthorised Product, device, treatment or modality combination;
(g) inadequate Client screening, informed consent, monitoring, after-care or escalation; or
(h) another act or omission of the purchaser, treating business, practitioner or their personnel.
Acceptance of these Terms does not waive any right that cannot lawfully be waived.
22. Suspension and Termination
We may reasonably suspend or terminate an account, professional access or access to restricted materials where necessary because of fraud, unlawful conduct, account security, unauthorised professional access, Product diversion, material breach of these Terms or a serious Product-safety or regulatory concern.
Where reasonably practicable, any action taken will be proportionate to the relevant issue.
Termination does not affect accrued obligations, statutory rights or provisions that by their nature are intended to survive termination.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, Products, operations, safety requirements, law, regulation or legitimate business requirements.
The current version will be published on this website with its last-updated date.
Material changes will apply prospectively and reasonable notice will be provided where required by law or reasonably practicable.
Changes to these Terms do not retrospectively remove statutory rights relating to completed purchases.
24. Entire Agreement and Other Agreements
These Terms and policies expressly incorporated into them govern use of the website and purchases made under these Terms.
Purchase of a Professional Trial Pack does not mean the purchaser has entered into the IDENEL Clinic Partner Agreement.
If the purchaser subsequently becomes an authorised IDENEL Clinic Partner and enters into a separate Clinic Partner Agreement, that agreement will govern the Clinic Partner relationship and impose additional obligations, including applicable ALTUM® Academy requirements.
Where another written agreement with IDENEL Australia expressly applies to a particular account or transaction, that agreement applies together with these Terms and prevails to the extent of any inconsistency concerning the subject matter specifically governed by that agreement.
Nothing in this Section excludes liability for fraud, misleading or deceptive conduct or another right or remedy that cannot lawfully be excluded.
25. Assignment
Professional trial access, professional accounts and restricted training access must not be transferred to another person or business without written authorisation from IDENEL Australia.
Luxura Australia Pty Ltd may transfer or assign its rights and obligations under these Terms to a related body corporate or a person that acquires or succeeds to all or substantially all of its IDENEL Australia business, provided that doing so does not unlawfully reduce the purchaser's substantive rights.
26. Severability and Waiver
If any provision of these Terms is invalid or unenforceable, it will be read down to the minimum extent necessary where legally possible.
If it cannot be read down, the affected portion will be severed without affecting the remaining provisions.
Failure or delay by a party in exercising a contractual right does not by itself constitute a waiver of that right.
27. Governing Law
These Terms are governed by the laws of Queensland, Australia.
Subject to any jurisdiction or right that cannot lawfully be excluded, the parties submit to the non-exclusive jurisdiction of the courts of Queensland and courts competent to hear appeals from those courts.
